The Russian authorities have found a way to keep films, TV series, music and other intellectual property objects of companies from unfriendly countries that have left the market or suspended work in the country. About this write "Vedomosti".
A bill is being developed specifically for this purpose, expanding the effect of the compulsory license, which already applies to various patents. This mechanism provides for the possibility of obtaining the rights to use an invention or industrial design through the court.
In the case of films and TV series, a Russian company with which a foreign partner unilaterally partially or completely renounced the license agreement on grounds unrelated to the violation of their contract will be able to apply to the court for obtaining a compulsory license.
In other words, all contracts can be renewed forcibly. The Russian licensee will be able to fulfill financial obligations under those contracts that were concluded after February 23, 2022, with shares.
Karen Ghazaryan, Director of the Internet Research Institute, believes that such a bill and its application in practice violates the Berne Convention and can have an extremely negative impact on the remaining prospects for international cooperation.
